Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on an Ahuriri rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on the Ahuriri rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there could be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager fails to supply the necessary information within 21 days of getting the notice, the tenant will receive an infringement notice and could be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or information. The person liable for this fine is whoever is identified on the tenancy agreement as the person who is renting the property which could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be correct when the tenancy contract is signed, and ideally it should be kept updated through the tenancy period as necessary work related to it is finished.

It’s also important to remember that landlords who have multiple rental properties could face additional fines for non-compliance. The harshest penalties are handed down for severe violations. Those who have more than six properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

When do I require to meet The Healthy Homes Standards?

Ahuriri Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Ahuriri and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with all Healthy Homes Standards that apply or will be applicable during the tenure of an apartment rental.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Ahuriri

Rental properties in Ahuriri must have a fixed heating source that can heat the living space to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.
