Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for an Ahuriri rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Ahuriri rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of being informed of the request, they will receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty of approximately $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is named on the tenancy agreement as being the person renting the property It could also be the name of the landlord or the property management company.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement throughout Ahuriri and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with the Healthy Homes Standard that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply to the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of when the tenancy began.

Draughts can lead to low temperatures inside households. A humid home is more expensive to heat, which means wasting money and energy.

A good heating system is crucial for well-being homes

Heating Ahuriri

Ahuriri rental properties need to have a stable source of heating that can warm the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to remain fixed (i.e., not portable), at least 1.5 kW in heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool may be used to determine whether the existing fix heater(s) are adequate or whether you will require to "top-up" with an additional heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters aren’t considered acceptable heating options in The Healthy Homes Standard.

For most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If the living area is already equipped with a fixed heating source like heat pumps, it could need an upgrade to meet the standards. Certain types of heaters cannot be used to achieve the quality because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Ahuriri

Each liveable space in a rental house must include at least one open door or window to offer natural airflow. In addition, humid areas such as kitchens or bathrooms need to have an externally vented extractor fan to remove moisture.

This ventilation standard is all about acknowledging that dry air will be much easier to heat and heat, and a property that is well ventilated will be less prone to developing damp and mould.

Bedrooms, living rooms kitchens and dining rooms are considered liveable spaces. Spaces that connect, such as the hallways are not liveable and do not need an opening door or window.

Insulation Ahuriri

Insulation for underfloor and ceilings has been compulsory for all rent houses since 1 July 2019. All landlords and property managers must make sure the insulation meets this new standard. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be added or replaced.

A properly insulated home will reduce the risk of condensation, and decrease the risk of dampness and mould, as well as making more easy to the house to keep the heat.
