Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on an Ahuriri rental property, all Healthy Homes compliance items need to be finished within 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on the Ahuriri rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of being informed of the request, they could receive an infringement notice and could be fined up to $750.

In addition, there is also a penalty as much as $900 for landlords or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and is updated through the tenancy period as associated work has been completed.

It is also important to note that a landlord who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for severe violations. Those who have more than six properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

When do I need to be in compliance with requirements of the Healthy Homes Standards?

Ahuriri Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Ahuriri and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with all Healthy Homes Standards that apply or will be in force during the tenure of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply according to Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Adequate heaters are crucial to ensure healthy homes

Heating Ahuriri

Ahuriri rental properties need to have a stable source of heat that can warm the largest or main living room to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements for it to be permanent (i.e. not portable), at least 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity to heat the living space in general. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings the smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source such as a heat pump, then it might just need a top up in order to comply with the standards. Some types of heaters can’t be utilised to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Ahuriri

Insulation Ahuriri

The insulation of the ceiling and underfloor is mandatory in all rental homes since 1 July 2019. Property managers and landlords have to make sure that the insulation is up to the new standard. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.

A house that is well-insulated can reduce condensation, and decrease the risk of mould and damp, and also makes an easier task to the house to keep warmth.
