Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance items have to be done within 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on the Ahuriri rental property, all Healthy Homes compliance work must be finished inside of 90 days.

All information in the Compliance Statement needs to be correct when the tenancy contract is signed. It should be kept updated through the tenancy period as associated work has been completed.

It is crucial to remember that landlords who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches, and landlords with more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Ahuriri and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with any Healthy Homes Standard that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Heating Ahuriri

Ahuriri rental properties require a reliable source of heat that is able to heat the principal or the biggest living area to at minimum 18degC, even on the winter coldest days. If the heating that you provide is an electric heater or heat pump, it must be equipped with the thermostat. This makes your heating more consistent and effective. In most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments the smaller fixed electric heater may suffice.

If your living space already has a permanent heating source, like the heat pump, it may need a top up to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality as they are either inefficient, unaffordable to operate or unsafe to operate.
