Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on an Akina rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on an Akina rental property, all Healthy Homes compliance work must be completed within 90 days.

If the landlord or property manager is unable to supply the information requested within 21 days from having received the inquiry, they will be issued an infringement notice and could be fined up to $750.

Furthermore, there’s also a fine of up to $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is named on the lease contract as the person renting the property and it could be the name of the landlord or the property management company.

All information in the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It is important to keep in mind that landlords who have multiple rental properties could face additional fines for non-compliance. The highest penalties are handed down for the most serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearings.

Akina Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Akina and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with any Healthy Homes Standard that apply or will be applied to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Akina

Akina rental properties should have a permanent source of heat that can warm the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

All landlords and property managers must ensure the insulation meets standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the subfloor space may require to be filled with or replaced.
