Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Bay View rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

Bay View Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Bay View and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From 1 July 2021

  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Bay View

In some instances, like apartments with small spaces, a smaller fixed electric heater might be enough.

If your main living space already has a permanent heating source, like an air conditioner, it might require a top up to meet the standards. Some types of heaters can’t be used to comply with the quality as they are either inefficient, unaffordable to operate and/or unhealthy to run.
