Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Bay View rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t supply the required information within 21 days from receiving the request, they may receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of up to $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is listed on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be correct when the tenancy contract is executed, and it should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It is also important to note that a landlord with multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for severe violations. Those who have six or more properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Bay View and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applicable during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers should make sure their rental properties comply with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.

Heating Bay View

Rental properties in Bay View must have a fixed source of heat that can warm the main or largest living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

Open fires and unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you provide is electric heating or heat source, it should include the thermostat. This makes the heating more consistent and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in some cases like small apartments an electric, fixed heater may be sufficient.

If your main living space already has a central heating source, such as a heat pump, then it may require an update in order to comply with the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.
