Healthy Homes Assessment Services

Did you not know that Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to make sure that their Clive rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Clive rental property, all Healthy Homes compliance work must be done inside of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Clive rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t provide the required information within 21 days of having received the inquiry, they may receive an infringement notice and could be fined up to $750.

In addition, there is also a penalty of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date before the tenancy agreement can be signed. It must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to keep in mind that landlords who have multiple rental properties may receive additional fines for non-compliance. The highest penalties are handed down for severe breaches, and landlords with six or more properties can be fined up to $50,000, and as much as $100,000 in hearings.

Clive Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Clive and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with the Healthy Homes Standard that apply or will be in force to the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Clive

Rental properties in Clive should have a permanent source of heat which can warm the principal or the biggest living room to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to be fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required for the main living room. If the heating you provide is electric heating (or heat pump), it should be equipped with the thermostat. This will help make the heating more reliable and efficient. For most houses, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, like small apartment buildings an electric, fixed heater might be enough.

If your living space already has a central heating source, like an air conditioner, it may require a top up to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Clive

Insulation for underfloor and ceilings is a requirement on all rental homes as of July 1st, 2019. Property managers and landlords must ensure that the insulation meets this new quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be replaced or replaced.
