Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Clive rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

As of 1st July 2021, when a new or renewed tenancy is signed on the Clive rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there could be an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from having received the inquiry, they may be issued an infringement notice and be fined upto $750.

In addition, there’s also a penalty of up to $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is identified on the tenancy agreement as the one who is letting the property out, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any relevant work gets completed.

It is also crucial to be aware that landlords with multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for severe violations, and landlords who own more than six properties could be penalised up to $50,000, and as much as $100,000 in hearings.

It is clear that failure to meet the Healthy Homes requirements can hit your wallet resulting in significant fines and continuing to be required to comply with the requirements. Do not risk your rental property Contact us now and request a home assessment performed on the rental property you are renting.

Healthy homes matter

Why is Healthy Homes Compliance so important?

About 1 in 3 households rent homes in New Zealand and Clive, and research shows us that these rental homes are likely to be older, colder, have less effective heating, and generally tend to be of poorer quality than homes that are owned by the owner.

Moldy, damp and cold houses are associated with negative well-being outcomes, especially for diseases like colds and asthma, as well as cardiovascular diseases. In addition, people who have reported four or more major issues with their housing often have poor life satisfaction and lower mental health.

Enhancing the quality of Clive rental property will allow tenants to enjoy improved mental and physical health and minimise the interruption to learning, work and living because of diseases. Your investment is also better safeguarded from mildew, mould and damp , which means less maintenance costs in the long run.

The Healthy Homes Standards are a set of specific and minimal standards for heating, insulation Ventilation and Ventilation and Drainage, as well as Draught Stopping on Clive rental properties.

Unreasonable Gaps & Holes

Draught Stopping Clive

Draughts are a major cause of less temperature in households. A damp house will cost more to heat, meaning wasting energy and incurring higher costs.

If a draught can be felt from unreasonable gaps or holes that it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a crack or a gap that is, it’s probably a gap or hole that needs sealing in somehow. Large gaps and cracks should be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit within your home need the sealing. In the case of an open fireplace isn’t in use it could cause draughts, and should be shut off. Property managers and landlords are responsible for ensuring that such draughts are squelched whenever imaginable.

There is no need to block off gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow movement of the structure when the house heats and cools, in order to let them be closed and opened instead of instead of being stuck. We will check all windows and doors during an Healthy Homes assessment of your rental property.

Heating Clive

Clive rental properties should have a permanent source of heat that can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements to remain fixed (i.e., not portable) with at least 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine if the existing installed heater(s) are sufficient or if you’ll require to "top up" with a new heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered acceptable heating options under those following the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it must be equipped with the thermostat. This makes the heating more reliable and effective. In most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, such as small apartments the smaller fixed electric heater could be enough.

If your living space already has a central heating source, like a heat pump, then it might need a top up to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard as they are either not effective, cost prohibitive to operate or are unsafe to operate.

Ventilation Clive

Every living space in a rental property must have at least one opening doors or windows to offer natural airflow. In addition, high moisture spaces like kitchens and bathrooms should have an venting fan outside to get rid of moisture.

A ventilation standard is all about understanding that dry air will be less difficult to heat and that the property that is properly ventilated is less likely to develop damp and mould.

Bedrooms, living rooms kitchens, and dining areas are considered to be liveable spaces. Connecting spaces such as the hallways are not living spaces and therefore do not require an opening window or door.

Each window, door , or the skylight needs at least of opening to the outside while remaining set in an opening position in order to allow the circulation of fresh air and ventilation.

Bathrooms, kitchens, and every other room of your home with shower, bath and cooktop or another moisture generating item will require suitable extractor fans that can be vented to the outdoors. This Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces that includes extractor fans that are suitable in areas with high moisture.

Insulation Clive

The insulation of the ceiling and underfloor has been compulsory for all rent homes since 1 July 2019. Property managers and landlords should make sure that the insulation is up to standards that are in line with the latest quality. In certain situations, the an existing insulation on the ceiling or in the subfloor space might require to be replaced or replaced.

A properly insulated home can help control condensation and reduce the chances of mould and dampness, as well as making it easier for the house to hold warmth.

Insulation requirements to be in compliance with the R-values required for your area

The "R" signifies thermal resistance, and is a gauge of how well insulation withstands heat flow. The higher the R-value, the more efficient the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3

Clive Moisture Ingress & Drainage

The security of your rental home from water damage isn’t only about what’s inside the building; you have to make sure there is somewhere to allow surface, rain or ground water and to prevent it from getting inside. When it concerns damp and moisture it is typically those things that you aren’t aware of that can become a big problem and cause damage to your investment as well as affecting your tenant’s well-being.

Rental properties must have efficient drainage to get rid of floodwaters, surface water and groundwater, with an appropriate runoff or outfall. Making sure the water has a place to go, and that it can’t linger underneath the buildings is a vital aspect of making sure your property is dry.

In addition to an irrigation system to stop the ingress of moisture, if your rental is enclosed between your flooring and ground, a ground moisture barrier must be put in place when it is reasonably practicable to do so.

An underground moisture barrier typically a sheet of polythene that is placed over the ground, to block any moisture in the ground from entering the property. It also assists in preventing from causing damage to the flooring insulation.
