Fines for Failing to Comply

Clive Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required throughout Clive and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with the Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform to the Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts can lead to low temperatures inside homes. A cold home is more expensive to heat, meaning wasting money and energy.

What are unreasonable gaps or holes?

If you can feel external air entering or an unobstructed draught coming from a gap or hole, then it is likely a crack or crack that needs sealing in some way. Large cracks and gaps should be stopped permanently. Gaps greater than 3mm that allow air to enter or exit into the home need seals. For instance, if an open fireplace isn’t in use it could cause draughts, and should be shut off. Property managers and landlords are responsible for ensuring such draughts are eliminated as much as imaginable.

You don’t need to block off holes or gaps in the construction. For example, tiny gaps around doors and windows could be necessary to allow for movement within the structure when the home warms and cools so that they are able to be opened and closed rather than securing. Heating Clive

Rental properties in Clive must have a fixed heating source which can warm the living room to at least 18degC even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs for it to be permanent (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool can be used to determine whether the installed heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Open fires as well as unflued combustion heaters like portable LPG bottle heaters are not considered to be acceptable heating options for The Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump, then it must include an thermostat. This will make your heating more consistent and efficient. For most houses, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces, a smaller fixed electric heater could be enough.

If the living area already has a fixed heating source, like a heat pump, then it may require an update to be able to meet the standards. Some types of heaters can’t be used to meet the standard because they’re costly, not cost-effective to run, and/or unsafe to run.

Ventilation Clive
