Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Clive rental property, all Healthy Homes compliance items have to be done within 90 days.

Clive Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Clive and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

From July 1st 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Adequate heaters are important to ensure healthy houses

Heating Clive

Clive rental properties must have a fixed source of heat that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to be fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum heating capacity needed for the main living room.
