Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Frasertown rental property, all Healthy Homes compliance items must be taken care of within 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Frasertown rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

Frasertown Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement in all Frasertown and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Frasertown

Rental properties in Frasertown need to have a stable source of heating that is able to heat the principal or the biggest living space to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

If your main living space already has a permanent heating source, like a heat pump, then it might need some additional energy to make sure it meets the requirements. Some types of heaters can’t be used to comply with the quality because they’re expensive, inefficient or are unsafe to operate.
