Did you not know that Healthy Homes Standards came into effective on July 1st, 2021? Landlords must ensure their Greenmeadows rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Greenmeadows rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on the Greenmeadows rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not provide the information requested within 21 days of receiving the request, they could receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for landlords and property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the one who is named on the tenancy contract as the person leasing the property out and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance requirements to be correct at the time that the tenancy agreement is signed, and ideally it must be updated during the entire tenancy, as relevant work gets completed.

It is important to be aware that landlords who manage several rental properties can face greater penalties for non-compliance. The highest penalties are reserved for the most serious violations. Those who have at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Greenmeadows Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement throughout Greenmeadows and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applied to an apartment rental.

From 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Greenmeadows

Draughts increase the likelihood of low temperatures inside households. A draughty home is more expensive to heat, meaning wasting energy and resulting in higher bills.

Rental properties in Greenmeadows must have a fixed source of heating that can warm the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs that it be permanently fixed (i.e., not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to determine whether the existing permanent heater(s) are sufficient or whether you will need to "top-up" with an additional heater. If the heating system you offer is an electric heater or heat source, then it must have the thermostat. This will help make the heating more reliable and efficient. For the majority of homes, bigger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments the smaller fixed electric heater may suffice.

If the main living room already has a fixed heating source, such as an air conditioner, it might just require an update to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Greenmeadows

Each living space within a rental property has to have at least one openable doors or windows to offer natural ventilation. Furthermore, moist spaces like kitchens and bathrooms must have a suitable externally vented extractor to remove moisture.

Living rooms, bedrooms, kitchens and dining rooms are considered liveable areas. Connecting spaces like the hallways are not liveable and therefore don’t require an opening window or door.

Every window, door or skylight needs to be able to open to the outside, and stay closed to allow for fresh air circulation and ventilation.

Bathrooms, kitchens, and any other room in your house that houses shower, bath or cooktop, or any other moisture-producing item will need appropriate extractor fans that can be vented out to the outside. Insulation Greenmeadows

Underfloor and ceiling insulation is required on all rental houses since 1 July 2019. All landlords and property managers must make sure the insulation meets standards that are in line with the latest quality. In some instances, current ceiling insulation, or the insulation of the sub floor space might require to be filled with or replaced.
