Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Hastings Central rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on the Hastings Central rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement, there may be an additional penalty or infringement fee.

If the property manager fails to supply the required information within 21 days from getting the notice, the tenant will receive an infringement notice and be fined upto $750.

Hastings Central Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Hastings Central and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records of their compliance with all Healthy Homes Standard that apply or will apply to the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Hastings Central

Hastings Central rental properties should have a permanent source of heat that can warm the largest or main living room to at least 18degC, even during the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable) and at minimum 1.5 horsepower in capacity and have the minimum heating capacity needed in the living area. In most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If your living space is already equipped with a fixed heating source such as an air conditioner, it might just require an update to meet the standards. Some types of heaters can’t be used to meet the quality because they’re not effective, cost prohibitive to operate or are unsafe to operate.

Ventilation Hastings Central

Each living space within a rental property must contain at minimum one open doors or windows to provide natural airflow. In addition, high moisture areas like kitchens and bathrooms should have an externally vented extractor to eliminate moisture.

Insulation Hastings Central
