Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Hastings rental property, all Healthy Homes compliance items must be completed within 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Hastings rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to provide the necessary information within 21 days from being informed of the request, they could receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is identified on the tenancy contract as the person letting the property out which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date before the tenancy agreement can be executed, and it should be maintained during the entire tenancy, as relevant work gets completed.

It is important to remember that a landlord who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for serious violations, and landlords who own six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Hastings Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory for all Hastings and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to all Healthy Homes Standards that apply or will be applicable to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Draught Stopping Hastings

Draughts are a major cause of low temperatures inside households. A humid home will cost more to heat, resulting in wasted energy and increased bills.

Heating Hastings

Rental properties in Hastings should have a permanent source of heat that can heat the living space to a minimum of 18degC, even during the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may be sufficient.

If the main living room is already equipped with a fixed heating source like the heat pump, it might just need a top up to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Insulation Hastings

Insulation for underfloor and ceilings has been compulsory for all rent houses from 1 July 2019. All landlords and property managers have to make sure the insulation meets this new quality. In some instances, old ceiling insulation as well as insulation within the subfloor space may need to be added or replaced.
