Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Hastings rental property, all Healthy Homes compliance items need to be done inside of 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on a Hastings rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to provide the information requested within 21 days from having received the inquiry, they can receive an infringement letter and could be fined up to $750.

Furthermore, there’s an additional fine of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the lease contract as the person renting the property which could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as related work is completed.

It is important to keep in mind that a landlord who manage several rental properties can face additional fines for non-compliance. The harshest penalties are given for serious breaches. Landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Hastings Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement to all Hastings and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

You don’t need to block off gaps or holes in the construction. Heating Hastings

Rental properties in Hastings must have a fixed heating source that can heat the living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements to be fixed (i.e. not portable) with at least 1.5 kW of heating capacity, and meet the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to check if the existing permanent heater(s) are adequate or if you’ll need to "top up" with a new heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered acceptable heating options in the Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it should have the thermostat. This makes the heating more consistent and efficient. For the majority of homes, bigger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments small apartments, a smaller electric fixed heater could be enough.

If your living space is already equipped with a fixed heating source like a heat pump, then it may need an update to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Hastings

Insulation Hastings

The insulation of the ceiling and underfloor is a requirement on all rental homes from 1 July 2019. Property managers and landlords have to make sure that the insulation is in line with standards that are in line with the latest quality. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be topped up or replaced.
