Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Haumoana rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for the Haumoana rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not supply the information requested within 21 days of having received the inquiry, they can receive an infringement notice and be fined as high as $750.

In addition, there is also a penalty of up to $900 for landlords and property managers that provide false or false Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is listed on the tenancy contract as the person leasing the property out which could be the name of the landlord as well as the company that manages the property.

Haumoana Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement to all Haumoana and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standards that apply or will apply to the rental property.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

What are unreasonable gaps or holes?

If you are able to feel external air getting in, or see the air is clear from a crack or a gap and you are able to feel it, it’s likely to be a gap or crack that needs sealing in any way. Large gaps and cracks should be stopped permanently. The gaps that exceed 3mm that allow air in or out into your house need the sealing. For example, if an open fireplace is not in use, it may cause draughts and should be blocked off. Property managers and landlords are accountable for ensuring that such draughts are squelched whenever imaginable.

There is no need to block holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow movement of the structure as the home gets warmer and cooler, so that they can still be closed and opened rather instead of being stuck. A good heating system is important for healthy homes

Heating Haumoana

Rental properties in Haumoana must have a fixed source of heat which can warm the main or largest living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs to be fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether the fixed heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered to be safe heating options under those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, then it must be equipped with a thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments an electric, fixed heater could be enough.

If the living area already has a permanent heating source like a heat pump, then it may require some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality since they’re either costly, not affordable to run, or are unsafe to operate.

Ventilation Haumoana

The insulation of the ceiling and underfloor is a requirement for all rent houses since 1 July 2019. All landlords and property managers should make sure that the insulation meets current quality. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may need to be added or replaced.

A properly insulated home will reduce the risk of condensation and lower the chance of mould and dampness, and will also make it easier to the house to keep the heat.

The "R" is a symbol for thermal resistance, and is a gauge of how well the insulation resists heat flow. The more high the R-value, more effective the insulation.
