Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Havelock North Central rental property, all Healthy Homes compliance items must be completed within 90 days.

It’s also important to remember that landlords with several rental properties can face even higher fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all Havelock North Central and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
