Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Hospital Hill rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement throughout Hospital Hill and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

What are unreasonable gaps and holes?

If you can feel external air entering or the sound of a clear draught emanating from a hole or gap that is, it’s most likely a gap or an opening that needs sealing in somehow. Large gaps and cracks should be stopped permanently. Gaps greater than 3mm that allow air in or out of the home require seals. In the case of an open fireplace isn’t being used, it could cause draughts, and should be blocked from. Property managers and landlords are responsible for ensuring that these draughts are stopped as far as imaginable.

You don’t need to block holes or gaps in the construction. For instance, small gaps around windows and doors could be necessary to allow for movement within the building when the household gets warmer and cooler, to allow them to be closed and opened instead of instead of being stuck. Heating Hospital Hill

Hospital Hill rental properties should have a permanent source of heating that can warm the main or largest living area to at minimum 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements to be fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity in the living area. Unflued combustion and open fire heaters like portable LPG bottle heaters are not considered to be safe heating options under the Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), then it must have a thermostat. This makes the heating more consistent and effective. For the majority of houses, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like small apartments an electric, fixed heater may be sufficient.

If your living space already has a permanent heating source, such as the heat pump, it might just require an update in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.
