Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Hospital Hill rental property, all Healthy Homes compliance work must be finished within 90 days.

Beginning on July 1st, 2021, once a new or renewed Tenancy is signed for a Hospital Hill rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy contract, there may be additional penalties or an infringement fee.

If the landlord or property manager does not provide the necessary information within 21 days of receiving the request, they will receive an infringement notification and be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is named on the tenancy agreement as being the person leasing the property out which could be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed. It is updated during the entire tenancy, as necessary work related to it is finished.

When Do I need to be in compliance with the Healthy Homes Standards?

Hospital Hill Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Hospital Hill and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with the Healthy Homes Standards that apply or will be in force to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of dropping temperatures within homes. A draughty house will cost more to heat, meaning wasting money and energy.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see a clear draught out of a hole or gap, then it is most likely a gap or an opening that needs sealing in any way. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air in or out of your home require sealing. There is no need to block up intentional holes or gaps which are part of the construction. For example, tiny gaps around windows and doors may be required to allow for movement within the structure when the home warms and cools in order to let them be opened and closed rather than sticking. Heating Hospital Hill

Hospital Hill rental properties need to have a stable source of heat that can warm the living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. If the heating you offer is electric heating or heat pump, it must include a thermostat. This will help make the heating more reliable and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like small apartment buildings an electric, fixed heater could be enough.

If the living area already has a central heating source, like a heat pump, then it may need an upgrade to be able to meet the standards. Certain kinds of heaters aren’t able to be used to meet the quality because they’re not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Hospital Hill

All landlords and property managers must make sure that the insulation meets standards that are in line with the latest standard.
