Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Kingsley-Chatham rental property, all Healthy Homes compliance work have to be finished within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Kingsley-Chatham rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. All the information on the Statement of Compliance needs to be accurate when the tenancy contract is completed, and is updated throughout the tenancy as any related work is completed.

It is also crucial to be aware that a landlord who manage several rental properties can face greater penalties for non-compliance. The highest penalties are reserved for severe breaches. Landlords with at least six rental properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

When should I need to meet requirements of the Healthy Homes Standards?

Kingsley-Chatham Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory for all Kingsley-Chatham and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the conformance to each Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

From July 1st 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Rental properties in Kingsley-Chatham must have a fixed heating source which can warm the main or largest living space to at least 18degC, even during the coldest days of the year. Ventilation Kingsley-Chatham
