Fines for Failing to Comply
Since the 1st July of 2021, once a new or renewed tenancy is signed for a Kingsley-Chatham rental property, all Healthy Homes compliance work need to be finished within 90 days.
From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for a Kingsley-Chatham rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to meet any of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not incorporated within a new, renewed or amended tenancy agreement there may be an additional penalty or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to supply the information requested within 21 days of having received the inquiry, they can receive an infringement notification and be fined as high as $750.
In addition, there’s an additional fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as the person who is who is letting the property and it could be the name of the landlord, or the company that manages the property.
The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it must be updated during the entire tenancy, as related work is completed.
It is also important to keep in mind that landlords who manage multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.
