Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Kingsley-Chatham rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on the Kingsley-Chatham rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in an updated, renewed, or amended tenancy agreement it could result in an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not supply the necessary information within 21 days from being informed of the request, they could be issued an infringement notice and could be fined up to $750.

In addition, there’s also a fine of approximately $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be current before the tenancy agreement can be signed. It should be kept updated during the entire tenancy, as related work is completed.

It’s crucial to keep in mind that a landlord who own multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for serious breaches. Landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in hearings.

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Kingsley-Chatham and New Zealand rental houses where it is reasonably practicable to put in.
