Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Mangateretere rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance work must be completed within 90 days.
Inability to adhere to each of Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.
Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the necessary information within 21 days from having received the inquiry, they could be issued an infringement notice and be fined up to $750.
In addition, there’s an additional fine of approximately $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is listed on the tenancy agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.
All the information on the Statement of Compliance requirements to be current when the tenancy agreement is completed, and is updated during the entire tenancy, as associated work has been completed.
It’s important to be aware that a landlord who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved for severe violations. Those who have at least six rental properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.
