Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance items must be finished within 90 days.

As of 1st July 2021, once a new, renewed or varied Tenancy is signed for the Mangateretere rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, there is also a penalty of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible to pay this fine is the one who is named on the lease contract as the person who is letting the property which could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be correct when the tenancy contract is signed. It is updated during the entire tenancy, as relevant work gets completed.

It is also important to keep in mind that a landlord who own multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved only for serious breaches, and landlords with six or more properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

When do I require to meet my Healthy Homes Standards?

Mangateretere Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required throughout Mangateretere and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate conformance with the Healthy Homes Standard that apply or will be in force during the tenure of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Mangateretere

Rental properties in Mangateretere must have a fixed source of heating that is able to heat the principal or the biggest living area to at minimum 18degC, even on the coldest days of the year. If the heating system you provide is electric heating (or heat pump), it should include a thermostat. This makes your heating more consistent and efficient. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like apartments with small spaces an electric, fixed heater may be sufficient.

If your main living space already has a permanent heating source, such as the heat pump, it might need an upgrade to meet the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either expensive, inefficient or unsafe to operate.

Insulation Mangateretere

Insulation for underfloor and ceilings has been compulsory in all rental houses since July 1, 2019. Property managers and landlords are required to ensure that the insulation is up to standards that are in line with the latest standard.
