Did you not know that Healthy Homes Standards came into in force on July 1, 2021? Landlords are now required to ensure that their Maraenui rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals are required to be fully in compliance by July 1st 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Maraenui rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed Tenancy is signed for a Maraenui rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the the property manager doesn’t supply the required information within 21 days from having received the inquiry, they can receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty of up to $900 for property owners or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy contract as the person letting the property out and it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance needs to be current when the tenancy contract is completed, and is updated throughout the tenancy as any associated work has been completed.

It is important to note that a landlord who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for serious breaches. Landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

Maraenui Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory in all Maraenui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers have to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts increase the likelihood of low temperatures inside homes. A draughty home costs more to heat, which means wasting money and energy.

Proper heating is crucial for healthy homes

Heating Maraenui

Rental properties in Maraenui need to have a stable heating source which can warm the principal or the biggest living space to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to be fixed (i.e., not portable), at minimum 1.5 horsepower in capacity and have the minimum required heating capacity to heat the living space in general. The Heating Assessment Tool can be used to check if your current fixed heater(s) are adequate or whether you will require to ‘top up’ by adding a second heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be acceptable heating options in The Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump it needs to have the thermostat. This will make your heating more consistent and efficient. In most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments small apartments, a smaller electric fixed heater may be sufficient.

If your living space is already equipped with a fixed heating source such as an air conditioner, it might require some additional energy to make sure it meets the requirements. Certain types of heaters cannot be used to meet the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Maraenui
