Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Maraenui rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Maraenui rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement it could result in an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager does not supply the information requested within 21 days of being informed of the request, they could receive an infringement notice and could be fined up to $750.

In addition, there’s an additional fine of approximately $900 for property owners or property managers who offer a false or incorrect Healthy Homes Compliance Statement or other information. The person who is liable for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be accurate when the tenancy contract is signed, and ideally it must be updated during the entire tenancy, as necessary work related to it’s finished.

It’s also important to remember that landlords who have multiple rental properties could face additional fines for non-compliance. The most severe penalties are reserved for the most serious breaches. Landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

When Do I require to be in compliance with The Healthy Homes Standards?

Maraenui Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is required in all Maraenui and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Rental properties in Maraenui must have a fixed heating source which can warm the main or largest living area to at minimum 18 degrees Celsius, even on the winter coldest days.
