Fines for Failing to Comply
Since the 1st July of 2021, when a new or renewed contract is signed on a Mohaka rental property, all Healthy Homes compliance tasks have to be finished within 90 days.
From the 1st of July in 2021, when a new or renewed tenancy is signed on the Mohaka rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Inability to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, there may be an additional penalty or infringement fee.
Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the required information within 21 days of having received the inquiry, they could receive an infringement notification and be fined upto $750.
In addition, there’s an additional fine of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is named on the tenancy contract as the person letting the property out and it could be the name of the landlord as well as the company that manages the property.
All information in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it is updated during the entire tenancy, as necessary work related to it is finished.
It is crucial to keep in mind that a landlord who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are reserved for the most serious breaches. Landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.
