Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Mohaka rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for a Mohaka rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement there could be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager fails to supply the required information within 21 days from being informed of the request, they can receive an infringement notification and be fined up to $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is identified on the tenancy contract as the person leasing the property out It could also be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and must be updated throughout the tenancy as any related work is completed.

It is crucial to note that landlords who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are handed down for the most serious breaches, and landlords with six or more properties can receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Mohaka Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Mohaka and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes
