Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Mohaka rental property, all Healthy Homes compliance work must be done by the end of 90 days.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any associated work has been completed.

It is crucial to keep in mind that a landlord with several rental properties can face even higher fines for non-compliance. The highest penalties are reserved for severe breaches, and landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Mohaka Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Mohaka and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or modified tenancy agreement.

Unreasonable Gaps & Holes

Draught Stopping Mohaka

Draughts can lead to lower temperatures in homes. A draughty home is more expensive to heat, which means wasting energy and resulting in higher bills.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming out of a hole or gap, then it is likely to be a gap or hole which needs sealing in any way. Large gaps and cracks should be stopped permanently. Any gaps greater than 3mm that let air into or out within your home need the sealing. For example, if the open fireplace isn’t in use it can create draughts. This should be sealed off. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed as much as imaginable.

There is no need to cover up holes or gaps in the building. For instance, small gaps around doors and windows could be required to allow for the movement of the structure when the home heats and cools, so that they are able to be opened and closed rather than being stuck. Heating Mohaka

Rental properties in Mohaka must have a fixed source of heating which can warm the largest or main living space to a minimum of 18degC, even during the coldest days of the year. If the living area already has a central heating source, such as the heat pump, it might need an update to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.
