Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Napier South rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to meet any of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, there could be an additional penalty or infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to provide the required information within 21 days from being informed of the request, they could receive an infringement notification and be fined as high as $750.
Furthermore, there’s also a penalty approximately $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property and it could be the name of the landlord, or the property management company.
All the information on the Compliance Statement needs to be correct before the tenancy agreement can be executed, and it should be maintained through the tenancy period as related work is completed.
It’s crucial to keep in mind that landlords with multiple rental properties could face more severe penalties for not complying. The harshest penalties are given for severe breaches, and landlords with six or more properties could be fined up to $50,000, and as much as $100,000 in hearing claims.
