Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Napier South rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on the Napier South rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is letting the property out It could also be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance requirements to be current when the tenancy contract is completed, and should be kept updated through the tenancy period as associated work has been completed.

It’s important to be aware that a landlord who own multiple rental properties may receive additional fines for non-compliance. The highest penalties are given for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Napier South Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required for all Napier South and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Napier South

Napier South rental properties should have a permanent heating source that can warm the main or largest living room to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements for it to be permanent (i.e., not portable), at minimum 1.5 kW of heating capacity, and meet the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to check if your current fixed heater(s) are adequate or if you’ll need to "top up" with an additional heater. Open fires and unflued combustion heaters such as portable LPG bottle heaters are not considered to be suitable heating options under the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it should include a thermostat. This will help make the heating more uniform and effective. In most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like small apartment buildings the smaller fixed electric heater may suffice.

If the main living room already has a permanent heating source, like a heat pump, then it could require some additional energy in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard since they’re either expensive, inefficient or unsafe to operate.

Ventilation Napier South

Insulation Napier South

The insulation of the ceiling and underfloor is required for all rent houses as of July 1st, 2019. Property managers and landlords should make sure that the insulation meets current standard.
