Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on an Onekawa rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on an Onekawa rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement there could be an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t provide the required information within 21 days of being informed of the request, they will receive an infringement letter and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement requirements to be accurate when the tenancy contract is completed, and should be kept updated during the entire tenancy, as relevant work gets completed.

It’s also important to remember that landlords who have multiple rental properties could face greater penalties for non-compliance. The highest penalties are reserved for serious breaches. Landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Onekawa Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory for all Onekawa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to all Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or the air is clear out of a hole or gap and you are able to feel it, it’s most likely a gap or hole which needs sealing in some way. Cracks and gaps that are large should be permanently stopped. Any gaps greater than 3mm that allow air in or out of your house require seals. For example, if an open fireplace isn’t being used, it can cause draughts and should be sealed off. You don’t need to block off holes or gaps that are part of the building. Adequate heaters are important for well-being houses

Heating Onekawa

Onekawa rental properties should have a permanent source of heating that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements to be fixed (i.e., not portable), at least 1.5 kW of heating capacity and have the minimum heating capacity needed for the main living room. Ventilation Onekawa
