Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for an Onekawa rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on an Onekawa rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

Onekawa Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required to all Onekawa and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with each Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.
