Fines for Failing to Comply
Since the 1st July of 2021, once a new or renewed contract is signed on an Onekawa rental property, all Healthy Homes compliance items have to be done within 90 days.
Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for the Onekawa rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to comply with any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there could be an additional fine or violation fee.

If the the property manager doesn’t provide the required information within 21 days from getting the notice, the tenant can receive an infringement notice and be fined as high as $750.
In addition, there’s also a fine of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord, or the company that manages the property.
The information contained in the Statement of Compliance requirements to be current before the tenancy agreement can be completed, and should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.
It’s also crucial to remember that landlords who have several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for serious breaches. Landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.
