Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to make sure that their Pakipaki rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rental properties must be fully certified by 1 July 2024.

Inability to meet the standards in the Healthy Homes Standards is a breach of the Residential Tenancies Act 1986, and any landlord found to not following the rules could be subject to fines of up to $7200 plus any additional healthier homes related fines.

Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Pakipaki rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied Tenancy is signed for the Pakipaki rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to each of Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of being informed of the request, they can receive an infringement notification and be fined as high as $750.

In addition, there is an additional fine of as much as $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate when the tenancy agreement is signed. It should be maintained throughout the tenancy as any related work is completed.

It’s important to note that landlords with several rental properties can face additional fines for non-compliance. The highest penalties are given only for serious breaches, and landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

When will I need to be in compliance with the Healthy Homes Standards?

Pakipaki Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Pakipaki and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate conformance with each Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of lower temperatures in houses. A cold house will cost more to heat, meaning wasting energy and increased bills.

If a draught can be perceived as a result of gaps or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air flowing in or the air is clear from a crack or a gap or crack, then it’s likely to be a gap or crack that needs sealing in the way you can. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that allow air in or out into your house need sealing. For instance, if an open fireplace isn’t in use it may cause draughts and should be blocked off. Landlords and property managers are responsible for ensuring such draughts are eliminated as far as imaginable.

You don’t require to block gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow movement of the structure when the home warms and cools so that they are able to be closed and opened rather than securing. The proper heating equipment is crucial for well-being houses

Heating Pakipaki

Pakipaki rental properties need to have a stable heating source which can warm the main or largest living area to at minimum 18degC even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to be fixed (i.e., not portable) and at least 1.5 kW of heating capacity, and it must have the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to check if the fix heater(s) are adequate or whether you will require to ‘top up’ with an additional heater. Fires that are open and unflued heaters, such as small portable LPG bottle heaters are not considered to be safe heating options for the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it requirements to have the thermostat. This will help make the heating more uniform and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like small apartments an electric, fixed heater could be enough.

If your living space already has a fixed heating source such as a heat pump, then it could require an update to make sure it meets the requirements. Certain types of heaters cannot be utilised to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Pakipaki

Each living space within the rental property should contain at minimum one open doors or windows to provide natural ventilation. In addition, high moisture areas such as kitchens or bathrooms should have an venting fan outside to get rid of moisture.

Underfloor and ceiling insulation is a requirement for all rent houses since July 1, 2019. Property managers and landlords have to ensure the insulation meets the new quality. In some cases, an existing insulation on the ceiling or in the sub floor space might require to be replaced or replaced.
