Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Pakipaki rental property, all Healthy Homes compliance items have to be finished within 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Pakipaki rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. All information in the Compliance Statement requirements to be correct before the tenancy agreement can be signed. It should be kept updated through the tenancy period as relevant work gets completed.

It’s also important to keep in mind that landlords who manage multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for serious breaches, and landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Pakipaki Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory for all Pakipaki and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove conformance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Pakipaki rental properties should have a permanent source of heat that is able to heat the principal or the biggest living space to a minimum of 18degC, even on the winter coldest days.
