Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to ensure their Pakipaki rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be completely in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Pakipaki rental property, all Healthy Homes compliance items must be done within 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on the Pakipaki rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not supply the information requested within 21 days from being informed of the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a fine of approximately $900 for landlords and property managers who provide a false or misleading Healthy Homes Statement of Compliance or information. The person responsible to pay this fine is the one who is named on the tenancy agreement as the one who is renting the property and it could be the name of the landlord or the property management company.

All the information on the Compliance Statement needs to be correct when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is important to be aware that a landlord with multiple rental properties could face even higher fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own six or more properties can be fined as high as $50,000, and as much as $100,000 in hearings.

Pakipaki Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory in all Pakipaki and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will apply to the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply with the Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Draughts increase the likelihood of dropping temperatures within households. A draughty home costs more to heat, resulting in wasted energy and increased bills.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a gap or hole, then it is most likely a gap or hole which requirements sealing in the way you can. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that allow air in or out within the home require sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and must be sealed off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as much as possible.

You don’t need to block up intentional holes or gaps which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow for movement within the building as the house is heated and cools so that they can still be shut and opened, rather instead of being stuck. A good heating system is important to ensure well-being houses

Heating Pakipaki

Pakipaki rental properties require a reliable source of heat that is able to heat the largest or main living space to a minimum of 18degC even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to be fixed (i.e., not portable), at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity to heat the living space in general. Ventilation Pakipaki

Insulation for underfloor and ceilings is mandatory for all rent houses from 1 July 2019. All landlords and property managers should make sure that the insulation is up to standards that are in line with the latest quality.
