Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure that their Pakipaki rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Pakipaki rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on the Pakipaki rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager does not supply the necessary information within 21 days from having received the inquiry, they could receive an infringement notice and be fined up to $750.

In addition, there’s also a penalty of approximately $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is listed on the tenancy contract as the person renting the property It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is completed, and is updated through the tenancy period as relevant work gets completed.

It is also important to be aware that a landlord who manage several rental properties can face even higher fines for non-compliance. The highest penalties are reserved for serious violations, and landlords who own six or more properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Pakipaki Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory for all Pakipaki and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to all Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes
