Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Parkvale rental property, all Healthy Homes compliance items have to be taken care of inside of 90 days.

The person liable for this fine is whoever is listed on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed, and ideally it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It’s crucial to note that a landlord who own multiple rental properties may face more severe penalties for not complying. The highest penalties are given for serious breaches. Landlords with six or more properties can be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Parkvale Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement in all Parkvale and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
