Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Pirimai rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

The person who is liable for this fine is the person who is listed on the tenancy contract as the person who is letting the property It could also be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained during the entire tenancy, as relevant work gets completed.

It is crucial to note that landlords who own several rental properties can face greater penalties for non-compliance. The harshest penalties are given for severe violations. Those who have at least six rental properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Pirimai Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required to all Pirimai and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Pirimai

Pirimai rental properties should have a permanent heating source that is able to heat the living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

If the heating you provide is electric heating or heat pump it must be equipped with the thermostat. This makes the heating more consistent and effective. In most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases like small apartment buildings, a smaller fixed electric heater could be enough.

If your living space already has a permanent heating source, such as heat pumps, it could require an update in order to comply with the standards. Certain kinds of heaters cannot be used to meet the standard as they are either costly, not affordable to run, and/or unsafe to run.

Ventilation Pirimai

Every living space of the rental property should have at least one openable window or exterior door to provide natural airflow. In addition, high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor to eliminate moisture.
