Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for a Pirimai rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on the Pirimai rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Pirimai Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory for all Pirimai and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records of their the compliance with any Healthy Homes Standard that apply or will be in force during the tenure of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Proper heating is important to ensure healthy houses

Heating Pirimai

Pirimai rental properties require a reliable source of heat that is able to heat the principal or the biggest living space to a minimum of 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs for it to be permanent (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are sufficient or whether you will need to "top-up" with an additional heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered acceptable heating options for the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), then it must be equipped with the thermostat. This will make your heating more consistent and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments an electric, fixed heater might be enough.

If the living area is already equipped with a fixed heating source such as an air conditioner, it might just need a top up in order to comply with the standards. Certain types of heaters cannot be used to meet the quality because they’re expensive, inefficient and/or unsafe to run.
