Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Poraiti rental property, all Healthy Homes compliance items must be done within 90 days.

The highest penalties are reserved only for serious breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Poraiti Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory for all Poraiti and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
