Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Poukawa rental property, all Healthy Homes compliance work need to be done by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on the Poukawa rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Poukawa Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory in all Poukawa and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that prove the compliance with the Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

From July 1st 2021

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

In some instances, such as small apartments, a smaller fixed electric heater might be enough.
