Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Raupunga rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied Tenancy is signed for the Raupunga rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there could be an additional fine or violation fee.

If the landlord or property manager is unable to supply the necessary information within 21 days of getting the notice, the tenant will be issued an infringement notice and be fined as high as $750.

In addition, there’s also a penalty of as much as $900 for property owners or property managers who provide a false or incorrect Healthy Homes Compliance Statement or information. The person liable to pay this fine is the one who is named on the lease agreement as the person who is letting the property out which could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to remember that landlords with multiple rental properties could face additional fines for non-compliance. The most severe penalties are reserved for serious violations, and landlords who own more than six properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Raupunga Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement for all Raupunga and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a hole or gap, then it is most likely a gap or an opening that requirements sealing in the way you can. Large gaps and cracks should be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit into your house require sealing. Heating Raupunga

Raupunga rental properties need to have a stable heating source that is able to heat the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to be fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether the existing fixed heater(s) are adequate or whether you will require to top up with an additional heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered acceptable heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump then it must have the thermostat. This will help make the heating more consistent and efficient. For most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, like small apartments, a smaller fixed electric heater may suffice.

If your living space already has a central heating source, like heat pumps, it could require some additional energy in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Raupunga

Each living space within a rental property has to include at least one open doors or windows to offer natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should have an externally vented extractor to take moisture away.

Insulation Raupunga

The insulation of the ceiling and underfloor is mandatory to all rental homes from 1 July 2019. All landlords and property managers are required to ensure the insulation meets standards that are in line with the latest standard. In certain situations, the current ceiling insulation, or the insulation of the subfloor space might need to be filled with or replaced.

A house that is well-insulated will reduce the risk of condensation and lower the chance of mould and damp, and also makes it easier to allow the household to retain warmth.
