Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Raupunga rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

As of 1st July 2021, once a new or renewed contract is signed on the Raupunga rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement, it could result in an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the necessary information within 21 days from getting the notice, the tenant will be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty of as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the person who is named on the lease agreement as the person who is renting the property which could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is completed, and is updated throughout the tenancy as any relevant work gets completed.

It is important to be aware that a landlord with several rental properties can face even higher fines for non-compliance. The harshest penalties are given for serious violations, and landlords who own six or more properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Raupunga Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Raupunga and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Raupunga need to have a stable source of heating which can warm the principal or the biggest living space to a minimum of 18degC even on the coldest days of the year. Property managers and landlords should ensure the insulation meets standards that are in line with the latest quality.
