Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Raupunga rental property, all Healthy Homes compliance tasks need to be done within 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Raupunga rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy contract, it could result in additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to supply the necessary information within 21 days of having received the inquiry, they can receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is named on the tenancy agreement as the one who is who is letting the property which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be completed, and should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s also important to be aware that a landlord who own multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down only for serious violations. Those who have six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Raupunga Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory to all Raupunga and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with each Healthy Homes Standards that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Draughts are a major cause of low temperatures inside households. A draughty home will cost more to heat, resulting in wasted energy and incurring higher costs.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a crack or a gap or crack, then it’s most likely a gap or an opening that needs sealing in the way you can. Cracks and gaps that are large should be stopped permanently. Any gaps greater than 3mm that let air into or out into the house require sealing. For instance, if an open fireplace is not in use, it could cause draughts, and should be blocked off. Landlords and property managers are responsible for making sure that these draughts are stopped as much as possible.

Heating Raupunga

Rental properties in Raupunga must have a fixed source of heat that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements to remain fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to check if the current fixed heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered acceptable heating options under The Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it requirements to include an thermostat. This will make the heating more uniform and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings, a smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source like heat pumps, it might just require an upgrade to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unsafe to run.

Ceiling and underfloor insulation is mandatory on all rental homes since 1 July 2019. Property managers and landlords should ensure that the insulation meets the new standard. In some cases, old ceiling insulation as well as insulation within the sub floor space may need to be replaced or replaced.
