Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure their Raureka rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Raureka rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Raureka rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the the property manager doesn’t supply the necessary information within 21 days from receiving the request, they will be issued an infringement notice and be fined as high as $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person liable for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance requirements to be current when the tenancy agreement is completed, and is updated throughout the tenancy as any associated work has been completed.

It’s also important to be aware that a landlord who own several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down for serious violations. Those who have more than six properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Raureka Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required for all Raureka and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with the Healthy Homes Standards that apply or will be applicable during the tenure of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy began.
