Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Roys Hill rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on a Roys Hill rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager fails to supply the necessary information within 21 days from receiving the request, they may receive an infringement letter and be fined as high as $750.

Furthermore, there’s also a penalty of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is named on the lease contract as the person who is letting the property and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy agreement is completed, and must be updated during the entire tenancy, as necessary work related to it is finished.

It’s also important to remember that a landlord who manage multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for serious breaches. Landlords with at least six rental properties could be fined up to $50,000, and even as high as $100,000 in hearings.

Unreasonable Gaps & Holes

Draught Stopping Roys Hill

Draughts are a major cause of low temperatures inside households. A cold house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draft can be perceived as a result of gaps or holes or holes, it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air entering or the air is clear from a crack or a gap, then it is likely a crack or an opening that needs sealing in any way. Cracks or gaps with large gaps must be permanently stopped. Cracks that are greater than 3mm and let air in or out within the house require the sealing. For instance, if an open fireplace isn’t in use it may cause draughts and should be blocked from. Landlords and property managers are accountable for ensuring that such draughts are squelched whenever imaginable.

There is no require to block up intentional gaps or holes which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement within the structure when the house gets warmer and cooler, to allow them to be closed and opened rather than securing. We will check all windows and doors as part of an Healthy Homes assessment of your rental property.

Heating Roys Hill

Roys Hill rental properties must have a fixed heating source that can heat the principal or the biggest living room to at least 18degC even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs that it be permanently fixed (i.e. not portable) and at minimum 1.5 kW in heating capacity and have the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to check if your current permanent heater(s) are sufficient or whether you will require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat source, it needs to include the thermostat. This will make the heating more consistent and effective. In most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like small apartments, a smaller fixed electric heater may suffice.

If the living area already has a fixed heating source, such as the heat pump, it may need some additional energy to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Every living space in a rental property has to contain at minimum one open doors or windows to offer natural airflow. In addition, high moisture areas like kitchens and bathrooms must have a suitable externally vented extractor to get rid of moisture.

Bedrooms, living rooms kitchens and dining rooms are all considered living spaces. Connecting spaces like the hallway aren’t living spaces and therefore do not need an opening window or door.

Every window, door or the skylight needs for them to be in a position to open to the outside while remaining fixed in an open position, allowing to circulate fresh air as well as air flow.

All bathrooms and kitchens as well as any other space in your home that has shower, bath and cooktop or another humidity-generating items will need suitable extractor fans that can be vented to the outdoors. The Healthy Homes Assessment service will ensure that there is sufficient air circulation in every living space with the right extractor fan in areas of high moisture.

Insulation Roys Hill

Ceiling and underfloor insulation is mandatory to all rental houses since 1 July 2019. All landlords and property managers must ensure that the insulation is in line with this new standard. In some cases, old ceiling insulation as well as insulation within the sub floor space might require to be topped up or replaced.

The "R" stands for thermal resistance, and is a measure of how well insulation withstands heat flow. The more R-value is higher, the better the insulation.

Roys Hill Moisture Ingress & Drainage

Protecting your rental property from the effects of moisture isn’t just a matter of the interior of the building; you have to ensure there is somewhere to allow surface, rain as well as groundwater to move, and also stop it from getting inside. When it concerns damp and moisture it’s often those concerns that you aren’t aware of that can cause a lot of trouble, causing damages to your investment and affecting your tenant’s health.

Properties that are rented must be equipped with effective drainage to remove floodwaters, surface water, and ground water, which includes the proper outfall or runoff. Making sure that the water has a place to go, and it doesn’t sit beneath buildings is a vital aspect of keeping your property dry.

In addition to a drainage system to prevent the ingress of moisture, if your rental has an enclosed gap between the floor and the ground, a ground moisture barrier must be installed if it’s reasonably practicable to install it.

Ground moisture barriers are generally a polythene sheet laid over the ground, in order to block any moisture from the ground from accumulating into the building. It also helps to prevent any damage to your underfloor insulation.
