Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Roys Hill rental property, all Healthy Homes compliance items need to be completed within 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Roys Hill rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included within the renewal, new or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to supply the information requested within 21 days of being informed of the request, they will receive an infringement notification and be fined as high as $750.

Additionally, there is also a fine of as much as $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy agreement as being the person who is letting the property and it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be maintained during the entire tenancy, as associated work has been completed.

It’s important to note that a landlord who manage several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

What time Do I require to be in compliance with the Healthy Homes Standards?

Roys Hill Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required in all Roys Hill and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with any Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Roys Hill rental properties must have a fixed source of heat that can warm the main or largest living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements to remain fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool could be used to determine whether your current installed heater(s) are adequate or if you’ll need to "top-up" with a new heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters aren’t considered to be safe heating options for the Healthy Homes Standard.

For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments an electric, fixed heater may be sufficient.

If the living area already has a permanent heating source, like a heat pump, then it may require a top up to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.
