Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed for a Roys Hill rental property, all Healthy Homes compliance work need to be done within 90 days.

As of 1st July 2021, if a new or renewed contract is signed on a Roys Hill rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t provide the necessary information within 21 days from receiving the request, they can receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty of approximately $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is named on the lease agreement as the one who is renting the property, so it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement needs to be correct at the time that the tenancy agreement is completed, and should be kept updated during the entire tenancy, as relevant work gets completed.

It’s important to remember that landlords who own multiple rental properties may face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

In the end, a failure to comply with your Healthy Homes requirements can hit your wallet hard, with massive fines as well as still having to meet compliance. Do not risk your rental property, contact us today and arrange to have an house inspection performed on your rental property.

Healthy homes matter

Why is Healthy Homes Compliance so important?

One in three households rent homes in New Zealand and Roys Hill, and research suggests that rental houses are most likely to be colder, older, are not as efficient heating, and generally have lower standard than those owned by owners.

The damp, cold and mouldy houses can have negative well-being results, specifically for illnesses like colds, influenza, asthma, and cardiovascular conditions. Furthermore, people who have reported at least four key issues with their housing often have poor life satisfaction and lower mental wellbeing.

Improving the standard of Roys Hill rental property can help tenants enjoy better mental and physical health as well as lessen interruption to learning, work and living due to illness. Your investment is also better protected from mildew, mould and damp damage, meaning lower costs for maintenance in the long run.

The Healthy Homes Standard is a listing of minimum and specific standards for Heating, Insulation Ventilation and Ventilation and Drainage, as well Draught Stopping on Roys Hill rental properties.

Unreasonable Gaps & Holes

Draught Stopping Roys Hill

Draughts may lead to dropping temperatures within houses. A cold house is more expensive to heat, resulting in wasted energy and increased bills.

If a draught could be perceived as a result of gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a hole or gap that is, it’s most likely a gap or hole that needs sealing in the way you can. Cracks and gaps that are large should be fixed permanently. Cracks that are greater than 3mm and allow air to enter or exit into your house require to be sealed. For instance, if an open fireplace is not in use, it could cause draughts, and should be sealed off. Property managers and landlords are accountable for ensuring such draughts are eliminated whenever imaginable.

You don’t need to cover up holes or gaps in the building. For instance, small gaps around windows and doors could be necessary to allow for the movement of the building as the home heats and cools, in order to let them be closed and opened instead of instead of being stuck. We will check the windows and doors during the Healthy Homes assessment of your rental property.

Adequate heaters are important for well-being houses

Heating Roys Hill

Roys Hill rental properties should have a permanent source of heating that can warm the principal or the biggest living room to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements for it to be permanent (i.e. not portable) with at least 1.5 kW of heating capacity, and must meet the minimum capacity for heating required in the living area. A Heating Assessment Tool can be used to determine if the existing fix heater(s) are sufficient or whether you will need to "top up" with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, then it must have a thermostat. This will help make your heating more consistent and efficient. For the majority of houses, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like small apartments the smaller fixed electric heater could be enough.

If the living area is already equipped with a fixed heating source, such as a heat pump, then it might need an update to be able to meet the standards. Certain types of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate or unsafe to operate.

Ventilation Roys Hill

Each liveable space in a rental property has to have at least one opening doors or windows to offer natural airflow. In addition, humid spaces like kitchens and bathrooms must have a suitable externally vented extractor fan that can get rid of moisture.

This ventilation quality is about recognising that the dry atmosphere is much easier to heat, and that an apartment that is well-ventilated is less likely to grow damp and mould.

Living rooms, bedrooms, kitchens, and dining rooms are considered liveable areas. Connecting spaces such as the hallway are not considered liveable and do not need an opening window or door.

Each window, door , or the skylight needs at least to open up to the outside and remain set in an opening position, allowing ventilation and fresh air ventilation.

Bathrooms, kitchens, and any other area in your house that houses shower, bath cooker or any other water-generating appliance will require appropriate extractor fans that vent out to the outside. The Healthy Homes Assessment service will verify that there is enough ventilation in each livable space with the right extractor fan in areas with high moisture.

Insulation Roys Hill

The insulation of the ceiling and underfloor is a requirement in all rental houses since 1 July 2019. Property managers and landlords should ensure the insulation meets the new standard. In some cases, an existing insulation on the ceiling or in the sub floor space might require to be filled with or replaced.

A well-insulated property can help control condensation, and decrease the risk of dampness and mould, and also makes an easier task to allow the home to hold warmth.

Insulation requirements to meet the R-values for your area

The "R" signifies thermal resistance and is a gauge of how well insulation is able to resist heat flow. The higher the R-value, the higher the standard of insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Roys Hill Moisture Ingress & Drainage

The security of your rental home from the effects of moisture isn’t just a matter of the interior of the building; you have to ensure there is somewhere for rain, surface or ground water and stop it from coming inside. When it comes to moisture and damp it is typically the things you don’t notice that can cause a lot of trouble and cause the property to suffer and harming your tenant’s health.

Rental properties need to be equipped with effective drainage to eliminate storm water, surface water, and ground water, which includes an appropriate runoff or outfall. Making sure the water has a location to go, and that it isn’t allowed to remain beneath buildings is a vital aspect of keeping your property dry.

Alongside a drainage system to avoid moisture from entering, if your apartment has an enclosed gap between floorboards and the ground, a ground water barrier must be put in place when it is reasonably practicable to install it.

An underground moisture barrier generally a polythene sheet laid over the ground to stop any moisture present in the ground from accumulating into the building. It also helps prevent water damage to the floor insulation.
