Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Roys Hill rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Roys Hill rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

It’s important to note that landlords who own several rental properties can face even higher fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Roys Hill Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Roys Hill and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to all Healthy Homes Standard that apply or will be applicable to their rental properties.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Rental properties in Roys Hill must have a fixed heating source that can heat the main or largest living space to at least 18 degrees Celsius, even on the coldest winter days.
