Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Roys Hill rental property, all Healthy Homes compliance items must be done inside of 90 days.

In addition, if the existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to provide the required information within 21 days from being informed of the request, they can receive an infringement notice and be fined upto $750.

Furthermore, there’s also a fine of up to $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is whoever is listed on the tenancy agreement as being the person letting the property out and it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as relevant work gets completed.

It’s also important to note that landlords who have several rental properties can face additional fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own six or more properties can be fined up to $50,000 and as high as $100,000 for hearing claims.

When Do I require to be in compliance with The Healthy Homes Standards?

Roys Hill Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required for all Roys Hill and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Rental properties in Roys Hill need to have a stable source of heating which can warm the living space to at least 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.
