Fines for Failing to Comply
Beginning on July 1st, 2021, if a new or renewed tenancy is signed for a St Leonards rental property, all Healthy Homes compliance items have to be taken care of within 90 days.
Since the 1st July of 2021, when a new or renewed lease is entered into on the St Leonards rental property, all Healthy Homes compliance work must be completed inside of 90 days.
Failure to adhere to each of Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager fails to supply the necessary information within 21 days from having received the inquiry, they may receive an infringement notice and be fined as high as $750.
In addition, there is also a fine of as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is named on the tenancy contract as the person who is letting the property which could be the name of the landlord or the property management company.
All information in the Compliance Statement needs to be current at the time that the tenancy agreement is signed. It should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.
It is also important to be aware that landlords with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have more than six properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.
