Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Tamatea rental property, all Healthy Homes compliance tasks must be finished within 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for the Tamatea rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the required information within 21 days from having received the inquiry, they could be issued an infringement notice and be fined upto $750.

In addition, there’s an additional fine of as much as $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is named on the lease agreement as being the person renting the property which could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It should be maintained throughout the tenancy as any necessary work related to it is finished.

It’s also important to remember that landlords with multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches. Landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.

Tamatea Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required throughout Tamatea and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Tamatea

Draughts can lead to lower temperatures in households. A damp home will cost more to heat, which means wasting energy and resulting in higher bills.

If a draught is felt from unreasonable gaps or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air coming in or the sound of a clear draught emanating from a hole or gap that is, it’s most likely a gap or an opening that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that let air into or out into your home require the sealing. For example, if the open fireplace isn’t used it could cause draughts, and should be blocked from. Property managers and landlords are accountable for making sure that these draughts are stopped as far as possible.

There is no need to block off gaps or holes that are part of the construction. For instance, small gaps around doors and windows could be required to allow for movement within the building when the household gets warmer and cooler, so that they are able to be shut and opened, rather than being stuck. Heating Tamatea

Tamatea rental properties must have a fixed heating source that can heat the living room to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to be fixed (i.e. not portable) and at least 1.5 kW of heating capacity and have the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to check if the existing installed heater(s) are adequate or whether you will require to "top-up" with a new heater. Open fires as well as unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it requirements to have the thermostat. This will help make the heating more uniform and efficient. Insulation Tamatea

Underfloor and ceiling insulation has been compulsory in all rental homes from 1 July 2019. Property managers and landlords have to make sure the insulation meets standards that are in line with the latest standard. In some cases, old ceiling insulation as well as insulation within the sub floor space may need to be replaced or replaced.

Tamatea Moisture Ingress & Drainage
