Fines for Failing to Comply
Beginning on July 1st, 2021, once a new or renewed contract is signed on a Taradale rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.
As of 1st July 2021, when a new, renewed or varied contract is signed on the Taradale rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Inability to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement it could result in additional penalties or an infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not provide the necessary information within 21 days from being informed of the request, they could receive an infringement notification and be fined up to $750.
In addition, there’s an additional fine of approximately $900 for landlords or property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is identified on the tenancy agreement as being the person letting the property out It could also be the landlord’s name or the company that manages the property.
All information in the Compliance Statement needs to be current before the tenancy agreement can be completed, and must be updated throughout the duration of the tenancy when any relevant work gets completed.
It is also crucial to note that landlords who have several rental properties can face even higher fines for non-compliance. The harshest penalties are given for serious violations, and landlords who own six or more properties could be fined up to $50,000, and as much as $100,000 in hearings.
