Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Te Hauke rental property, all Healthy Homes compliance work need to be completed within 90 days.

Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

When Do I require to be in compliance with the Healthy Homes Standards?

Te Hauke Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement in all Te Hauke and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with any Healthy Homes Standard that apply or will apply during the tenure of the rental property.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Te Hauke rental properties need to have a stable heating source that can warm the main or largest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to be fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum heating capacity needed for the main living room. In most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces, a smaller fixed electric heater could be enough.

If your living space already has a fixed heating source like an air conditioner, it might just require a top up to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality as they are either not effective, cost prohibitive to operate or are unsafe to operate.
