Healthy Homes Assessment Services

Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords must make sure their Te Mata rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties are required to be completely in compliance by July 1st 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Te Mata rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on the Te Mata rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the information requested within 21 days from getting the notice, the tenant could receive an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of up to $900 for property owners or property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance needs to be current when the tenancy agreement is signed. It must be updated through the tenancy period as related work is completed.

It’s crucial to keep in mind that landlords who have multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

What time Do I need to be in compliance with the Healthy Homes Standards?

Te Mata Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory for all Te Mata and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be applied to an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Te Mata

Draughts can lead to less temperature in households. A draughty house is more expensive to heat, which results in wasting energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes, it needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught out of a hole or gap that is, it’s likely a crack or an opening that needs sealing in any way. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that allow air in or out of the house require sealing. In the case of an open fireplace is not in use, it may cause draughts and must be sealed off. Landlords and property managers are accountable for ensuring such draughts are eliminated as far as possible.

There is no require to block up intentional holes or gaps that are part of the building. For example, tiny gaps around windows and doors might be necessary to allow for the movement of the building when the household heats and cools, in order to let them be closed and opened rather than sticking. A good heating system is important to ensure well-being houses

Heating Te Mata

Te Mata rental properties need to have a stable source of heat that can warm the living room to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e. not portable) and at least 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine whether the current fixed heater(s) are sufficient or if you’ll require to top up by adding a second heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered to be safe heating options under The Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), then it must have the thermostat. This makes the heating more reliable and effective. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. In certain situations, like small apartment buildings the smaller fixed electric heater may be sufficient.

If your main living space already has a permanent heating source, such as the heat pump, it may require a top up to be able to meet the standards. Some types of heaters can’t be used to meet the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Te Mata

The bathrooms in all kitchens and any other area in your house that houses shower, bath and cooktop or another humidity-generating items will require adequate extractor fans which are vented out to the outside. Insulation Te Mata

Underfloor and ceiling insulation is required for all rent houses from 1 July 2019. Property managers and landlords have to make sure that the insulation is up to standards that are in line with the latest standard. In some cases, old ceiling insulation as well as insulation within the subfloor space might need to be filled with or replaced.
