Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Te Mata rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Te Mata rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, it could result in an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager fails to supply the information requested within 21 days from receiving the request, they will be issued an infringement notice and be fined up to $750.

In addition, there’s an additional fine of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or any other information. The person liable for this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property and it could be the landlord’s name or the property management company.

It’s also crucial to note that landlords who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

When Do I need to meet my Healthy Homes Standards?

Te Mata Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Te Mata and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their compliance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Te Mata

Rental properties in Te Mata must have a fixed source of heating that can heat the principal or the biggest living space to at least 18degC, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable), at least 1.5 horsepower in capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether your current installed heater(s) are sufficient or whether you will require to top up with a new heater. Unflued combustion and open fire heaters, such as small portable LPG bottle heaters are not considered to be safe heating options for The Healthy Homes Standard.

If the heating you offer is electric heating or heat pump it should include a thermostat. This will help make the heating more consistent and effective. For most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances such as small apartments an electric, fixed heater could be enough.

If the main living room already has a permanent heating source such as heat pumps, it might just require some additional energy to make sure it meets the requirements. Certain types of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Te Mata

The insulation of the ceiling and underfloor is a requirement for all rent homes since 1 July 2019. All landlords and property managers should make sure that the insulation meets current quality. In some instances, an existing insulation on the ceiling or in the sub floor space might require to be replaced or replaced.
