Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Te Mata Hills rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied Tenancy is signed for the Te Mata Hills rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or the property manager doesn’t supply the required information within 21 days from having received the inquiry, they can receive an infringement letter and be fined as high as $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is listed on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy contract is executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to be aware that landlords with multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved for severe violations, and landlords who own six or more properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

When Do I need to be in compliance with my Healthy Homes Standards?

Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory to all Te Mata Hills and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties comply with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Heating Te Mata Hills

Te Mata Hills rental properties need to have a stable source of heat that is able to heat the principal or the biggest living area to at minimum 18degC, even during the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to be fixed (i.e., not portable) and at least 1.5 horsepower in capacity, and meet the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to determine if the current fix heater(s) are sufficient or if you’ll need to top up by adding a second heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump it should have the thermostat. This will make your heating more consistent and efficient. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases such as small apartments the smaller fixed electric heater might be enough.

If the living area already has a central heating source such as the heat pump, it might just need an upgrade to be able to meet the standards. Certain types of heaters cannot be utilised to meet the quality as they are either costly, not affordable to run, and/or unhealthy to run.

The insulation of the ceiling and underfloor is mandatory for all rent houses since July 1, 2019. Property managers and landlords are required to make sure the insulation meets this new quality.
