Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Te Mata Hills rental property, all Healthy Homes compliance items must be done by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on the Te Mata Hills rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the the property manager doesn’t supply the necessary information within 21 days from getting the notice, the tenant will receive an infringement notification and be fined up to $750.

In addition, there’s also a penalty as much as $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is named on the lease agreement as the one who is letting the property out, so it could be the name of the landlord, or the property management company.

It is important to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The most severe penalties are given for severe violations. Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required throughout Te Mata Hills and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the conformance to any Healthy Homes Standard that apply or will apply to an apartment rental.

From 1 July 2021

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Te Mata Hills

Te Mata Hills rental properties require a reliable source of heat which can warm the principal or the biggest living area to at minimum 18degC, even during the coldest winter days.
