Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Tomoana rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for a Tomoana rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Tomoana Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required for all Tomoana and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with all Healthy Homes Standard that apply or will be applied to an apartment rental.

From July 1st 2021

Heating Tomoana

Tomoana rental properties require a reliable heating source that can heat the main or largest living area to at minimum 18degC even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to be fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine if the fixed heater(s) are sufficient or if you’ll need to "top-up" with a new heater. If the heating system you offer is electric heating or heat source, it should include the thermostat. This will help make the heating more reliable and effective. In most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances like small apartments an electric, fixed heater could be enough.

If your main living space already has a permanent heating source, such as an air conditioner, it could need a top up in order to comply with the standards. Some types of heaters can’t be used to achieve the standard since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Tomoana
