Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Tomoana rental property, all Healthy Homes compliance items must be done inside of 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on a Tomoana rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to supply the necessary information within 21 days from being informed of the request, they may receive an infringement notification and be fined as high as $750.

In addition, there’s also a penalty of approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is listed on the tenancy contract as the person leasing the property out It could also be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be accurate when the tenancy agreement is completed, and should be maintained throughout the tenancy as any relevant work gets completed.

It is also important to remember that a landlord who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Tomoana Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory in all Tomoana and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with the Healthy Homes Standard that apply or will apply to your rental home.

Starting 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Draughts are a major cause of lower temperatures in houses. A humid home costs more to heat, resulting in wasted energy and incurring higher costs.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or an unobstructed draught coming out of a hole or gap, then it is probably a gap or crack that requirements sealing in the way you can. Cracks or gaps with large gaps must be sealed permanently. Any gaps greater than 3mm that let air in or out within the home require seals. In the case of an open fireplace is not in use, it could cause draughts, and must be sealed from. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed as far as possible.

You don’t need to block gaps or holes which are part of the construction. For instance, small gaps around windows and doors could be necessary to allow movement of the building as the home gets warmer and cooler, so that they are able to be closed and opened rather than being stuck. Adequate heaters are crucial for healthy homes

Heating Tomoana

Tomoana rental properties should have a permanent source of heating that can warm the main or largest living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements that it be permanently fixed (i.e., not portable) and at least 1.5 kW of heating capacity and have the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine if your current fix heater(s) are adequate or if you’ll require to top up by adding a second heater. Open fires as well as unflued combustion heaters such as portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

Underfloor and ceiling insulation has been compulsory for all rent houses since July 1, 2019. All landlords and property managers should make sure the insulation meets current standard. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be filled with or replaced.
