Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Tomoana rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Tomoana rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there could be an additional penalty or infringement fee.

If the property manager is unable to supply the required information within 21 days of receiving the request, they will receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty approximately $900 for landlords or property managers who provide a false or incorrect Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is listed on the tenancy agreement as the one who is who is letting the property, so it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be correct at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any necessary work related to it’s finished.

It is crucial to note that landlords with multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

Tomoana Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Tomoana and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Heating Tomoana

Rental properties in Tomoana must have a fixed source of heat that can heat the living space to a minimum of 18 degrees Celsius, even on the coldest winter days.
