Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Waipatu rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for the Waipatu rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to provide the necessary information within 21 days of having received the inquiry, they will be issued an infringement notice and could be fined up to $750.

In addition, there’s also a penalty of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the one who is named on the tenancy contract as the person letting the property out It could also be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be correct before the tenancy agreement can be completed, and should be maintained through the tenancy period as necessary work related to it is finished.

It’s crucial to keep in mind that landlords who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down only for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Waipatu Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Waipatu and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standards that apply or will be applicable to the rental property.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within houses. A cold house is more expensive to heat, resulting in wasted money and energy.

If a draft can be noticed from gaps that are not adequate or holes or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air entering or a clear draught from a hole or gap and you can feel it, it is likely to be a gap or crack that requirements sealing in any way. Large cracks and gaps should be permanently stopped. The gaps that exceed 3mm that let air in or out from your house need seals. For example, if the open fireplace is not in use, it could cause draughts, and should be sealed off. Proper heating is important to ensure healthy homes

Heating Waipatu

Waipatu rental properties need to have a stable source of heat that is able to heat the largest or main living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW of heating capacity, and it must have the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to determine if the current permanent heater(s) are adequate or if you’ll require to "top up" by adding a second heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters are not considered to be acceptable heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump it must include a thermostat. This will make your heating more consistent and efficient. For the majority of homes, bigger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartments small apartments, a smaller electric fixed heater could be enough.

If your main living space already has a permanent heating source like an air conditioner, it could require an upgrade in order to comply with the standards. Some types of heaters can’t be used to achieve the standard since they’re either expensive, inefficient or unsafe to operate.

Ventilation Waipatu

Every living space in a rental property must contain at minimum one open doors or windows to offer natural ventilation. Furthermore, moist areas such as kitchens or bathrooms need to have an externally vented extractor to take moisture away.

It is the ventilation quality is all about acknowledging how dried air can be more easy to heat, and that the property that is properly ventilated is less likely to grow damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t living spaces and therefore do not need an opening door or window.

Bathrooms, kitchens, and every other room of your home that has a bath, shower, cooktop or other high moisture generating item will need appropriate extractor fans which are vented out to the outside. Insulation Waipatu

Insulation for underfloor and ceilings has been compulsory on all rental houses since 1 July 2019. All landlords and property managers must ensure that the insulation meets current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.

A properly insulated home will reduce the risk of condensation and lessen the likelihood of mould and damp, as well as making it easier to allow the home to keep heat.

Waipatu Moisture Ingress & Drainage

Protecting your rental property from water damage isn’t only about what’s inside the building but you must ensure there is somewhere for rain, surface and ground water to go, and stop it from coming into the building. Rental properties should have effective drainage to get rid of rainwater, storm water, and ground water. This includes the proper outfall or runoff. Making sure the water has a proper place to go, and that it doesn’t sit beneath structures is an important aspect of making sure your property is dry.

Alongside the drainage system that will prevent water ingress, if the rental has an enclosed gap between the floor and the ground, a ground moisture barrier should be put in place if it is reasonably practicable to do so.

Ground moisture barriers are generally an insulating sheet of polythene laid over the ground, to block any moisture present in the ground from getting into the building. It also assists in preventing water damage to the floor insulation.
