Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Waipatu rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on the Waipatu rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there could be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t provide the information requested within 21 days from being informed of the request, they could receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is the one who is named on the lease agreement as the person who is leasing the property out and it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be correct at the time that the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any associated work has been completed.

It’s also important to remember that a landlord who have multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given only for serious violations. Those who have more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Waipatu Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Waipatu and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with the Healthy Homes Standards that apply or will be applicable during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties conform to the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Draughts can lead to less temperature in households. A draughty home is more expensive to heat, which results in wasting money and energy.

If a draught can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air entering or a clear draught from a crack or a gap or crack, then it is probably a gap or hole which requirements sealing in any way. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that let air into or out within your house require seals. For example, if an open fireplace isn’t used it could cause draughts, and should be shut from. Property managers and landlords are responsible for ensuring that these draughts are stopped as much as possible.

There is no require to block off holes or gaps that are part of the building. For example, tiny gaps around doors and windows could be required to allow for the movement of the building when the home warms and cools so that they are able to be closed and opened rather than securing. Heating Waipatu

Waipatu rental properties need to have a stable source of heat which can warm the living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements that it be permanently fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool can be used to check if the current installed heater(s) are sufficient or if you’ll require to ‘top up’ with a new heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating that you provide is electric heating or heat source, it should include a thermostat. This will make your heating more consistent and effective. For most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. In some instances, like small apartment buildings an electric, fixed heater may be sufficient.

If the main living room already has a fixed heating source, such as the heat pump, it might need some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality as they are either expensive, inefficient and/or unsafe to run.

Ventilation Waipatu

Each liveable space in a rental house must have at least one opening windows or an exterior door to offer natural airflow. In addition, high moisture areas such as kitchens or bathrooms need to have an externally vented extractor fan to take moisture away.

Insulation Waipatu

Underfloor and ceiling insulation is mandatory on all rental houses since July 1, 2019. All landlords and property managers have to ensure the insulation meets this new quality. In certain situations, the current ceiling insulation, or the insulation of the sub floor space might require to be replaced or replaced.
