Fines for Failing to Comply

It is also important to remember that landlords who have multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for severe violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

When Do I require to be in compliance with the Healthy Homes Standards?

Waipawa Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory to all Waipawa and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with any Healthy Homes Standard that apply or will apply to the rental property.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
