Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Whakatu rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Whakatu rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager fails to provide the required information within 21 days from receiving the request, they could receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers who provide a false or false Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is named on the lease agreement as being the person who is letting the property which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be current before the tenancy agreement can be signed. It is updated during the entire tenancy, as related work is completed.

It is crucial to remember that landlords who manage multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are given for severe breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Whakatu Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement to all Whakatu and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standards that apply or will be in force to their rental properties.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Whakatu

Whakatu rental properties must have a fixed source of heating that can heat the living area to at minimum 18degC even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements to be fixed (i.e. not portable), at least 1.5 kW of heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the current fix heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered to be safe heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat pump then it must include the thermostat. This will make the heating more reliable and effective. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases such as small apartments an electric, fixed heater might be enough.

If the main living room already has a fixed heating source, like an air conditioner, it might require an upgrade to ensure it meets the requirements. Some types of heaters can’t be utilised to meet the standard as they are either costly, not affordable to run, and/or unsafe to run.
