Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Whakatu rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

Whakatu Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory throughout Whakatu and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will apply during the tenancy of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.

Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in homes. A draughty house is more expensive to heat, which results in wasting energy and resulting in higher bills.

If a draught could be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or an unobstructed draught coming from a gap or hole and you can feel it, it is probably a gap or hole which requirements sealing in any way. Cracks and gaps that are large should be stopped permanently. Gaps greater than 3mm that let air into or out of the home need to be sealed. For instance, if an open fireplace is not in use, it can cause draughts and should be blocked off. Property managers and landlords are responsible for ensuring that these draughts are stopped as far as possible.

You don’t need to block up intentional holes or gaps that are part of the construction. For instance, small gaps around doors and windows could be necessary to allow for movement of the building when the house is heated and cools in order to let them be opened and closed rather instead of being stuck. Adequate heaters are important for healthy houses

Heating Whakatu

Rental properties in Whakatu require a reliable source of heating that can warm the principal or the biggest living space to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs for it to be permanent (i.e. not portable) with at least 1.5 horsepower in capacity, and must meet the minimum heating capacity needed to heat the living space in general. The Heating Assessment Tool can be used to determine if your current installed heater(s) are adequate or if you’ll require to "top-up" with an additional heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters are not considered to be acceptable heating options under those following the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it needs to have a thermostat. This will help make the heating more reliable and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, like small apartments the smaller fixed electric heater could be enough.

If the main living room is already equipped with a fixed heating source, such as a heat pump, then it might need a top up to be able to meet the standards. Some types of heaters can’t be utilised to meet the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Whakatu

Ceiling and underfloor insulation is a requirement in all rental houses since July 1, 2019. All landlords and property managers are required to ensure that the insulation is up to this new standard. In some instances, old ceiling insulation as well as insulation within the subfloor space may require to be topped up or replaced.
